Roundup, a weed killer developed by Monsanto, is one of the most popular herbicides used worldwide. Previously believed to be safe for humans, the chemical has recently come under fire, as lawsuit after lawsuit claim that the glyphosate-based product causes cancer.
Recent Cases
To date, there have been two major US trials against Bayer AG, which acquired Monsanto in 2018. In August of 2018, a California jury awarded plaintiff Dewayne Johnson, a former school groundskeeper, $289 million after evidence was presented that his long-term exposure to the weed killer caused non-Hodgkin’s lymphoma.
Johnson testified that he would have never used the product if he had been aware of the possibility it could cause cancer. The jury awarded the 46-year-old father of three $39 million for past and future losses and $250 million in punitive damages. The judge later reduced his total award to $78 million.
In a second case in March of 2019, a federal jury found that Monsanto’s weed killer was a ‘substantial factor’ in causing the non-Hodgkin’s lymphoma of Edwin Hardeman. In the first phase of his case, Hardeman testified that he used Roundup on his personal property to control weeds and poison oak for almost 30 years.
In the second phase of the case, Hardeman and his lawyers sought to prove that Monsanto and Bayer AG tried to downplay the health risks associated with Roundup by manipulating public opinion. In the end, the jury found that Monsanto failed to warn users of the potential dangers or take proper precautionary measures to prevent harm. Hardeman was awarded $80 million.
